As a tree owner you have a responsibility that your tree does not cause damage or injury to others. In law this is dealt with under Common Law Duty – the duty of care.

The question to ask is whether a reasonable person could have foreseen the potential for mechanical failure of the tree leading to damage to a person or property. As a tree owner therefore, one has to check trees and understand that the responsibility for the health, safety and maintenance of their trees is yours. Tree owners are expected to ensure with reasonable foresight of any health and safety implications that may cause damage to another person or property are rectified.

At we aim to keep tree owners informed of their responsibilities and assist when employing an arborist or tree surgeon to undertake work on a tree.
